These Terms of Service (“Terms”) govern your use of goosmart.net (the “Site”) and any purchase you make from Goosmart LLC (“Goosmart,” “we,” “us”). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund & Returns Policy.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. If you are younger, you may use the Site only with the involvement of a parent or guardian.
2. Products and made-to-order items
Our products are printed on demand after you order. We try to display colors and designs as accurately as possible, but the actual color of a printed item may vary slightly from what you see on your screen. Product availability may change without notice.
3. Pricing and payment
All prices are in U.S. dollars (USD). Prices, promotions, and products may change at any time without notice. Applicable sales tax and shipping are shown at checkout. Payments are processed by third-party payment providers; by paying, you confirm you are authorized to use the payment method.
4. Orders, acceptance, and cancellation
Your order is an offer to buy. We may refuse or cancel any order — for example, because of a pricing or product error, suspected fraud, or orders that appear to be placed by resellers. If we cancel after you’ve been charged, we will refund you in full. Customer cancellations are covered in our Refund & Returns Policy.
5. Shipping, returns, and refunds
Shipping times and rates are described in our Shipping Policy. Replacements and refunds are described in our Refund & Returns Policy. Title and risk of loss pass to you when the item is delivered to the carrier, but we will still help you with lost or damaged packages as described in those policies.
6. Intellectual property
All content on the Site — including designs, artwork, text, logos, photos, and graphics — is owned by Goosmart or its licensors and is protected by U.S. and international copyright and trademark laws. Buying a product gives you the right to use that item personally; it does not give you any right to copy, reproduce, or resell our designs. 7. Accounts
If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please keep your account and billing information accurate and up to date.
8. Prohibited uses
You agree not to: use the Site for any unlawful purpose; infringe our or anyone else’s intellectual property; upload viruses or malicious code; scrape, crawl, or copy the Site’s content or designs; interfere with the Site’s security or operation; or harass, abuse, or impersonate others.
9. Reviews, comments, and feedback
If you submit reviews, photos, comments, or ideas, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and share them in connection with our business. You are responsible for what you submit, and it must not be unlawful, misleading, or infringing.
10. Third-party links and tools
The Site may include links to or tools from third parties. We are not responsible for their content, products, or practices, and your use of them is at your own risk.
11. Errors and inaccuracies
The Site may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, or availability. We reserve the right to correct them and to update or cancel orders if information is inaccurate, even after you submit your order.
12. Disclaimer of warranties
Except as expressly stated in our policies, the Site and products are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, Goosmart and its members, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim related to an order will not exceed the amount you paid for that order.
14. Indemnification
You agree to defend, indemnify, and hold harmless Goosmart and its members, employees, and partners from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your violation of any law or the rights of a third party.
15. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. If you have a concern, please contact us first — most issues can be resolved quickly by email. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Laramie County, Wyoming, unless applicable law gives you the right to bring it elsewhere.
16. Severability and entire agreement
If any part of these Terms is found unenforceable, the rest will remain in effect. These Terms and the policies linked above are the entire agreement between you and Goosmart regarding the Site.
17. Changes to these Terms
We may update these Terms at any time by posting the new version on this page. Continuing to use the Site after changes means you accept them.
